จดทะเบียนสมรสกับชาวอังกฤษในประเทศไทย
ในปัจจุบัน การจดทะเบียนสมรสต่อสำนักทะเบียน ณ ที่ว่าการเขต/อำเภอในประเทศไทย นอกจากจะมีผลสมบูรณ์ตามกฎหมายไทยแล้ว ยังมีผลสมบูรณ์ตามกฎหมายสหราชอาณาจักรเช่นกัน คู่สมรสทั้งสองฝ่ายจะได้รับสิทธิความคุ้มครองตามกฎหมายทั้งของไทยและสหราชอาณาจักรทุกประการ จึงไม่ต้องจดทะเบียนสมรสในอังกฤษอีกครั้งเนื่องจากจะเป็นการจดทะเบียนสมรสซ้อนค่ะ

ชาวอังกฤษที่จะจดทะเบียนสมรสในประเทศไทย
ตามระเบียบของสำนักบริหารการทะเบียน กระทรวงมหาดไทย ชาวต่างชาติที่ต้องการจดทะเบียนสมรสในประเทศไทยอย่างถูกกฎหมาย ต้องยื่นหนังสือรับรองสถานภาพบุคคลที่ออกโดยสถานทูต หรือสถานกงสุล หรือองค์การของรัฐบาลประเทศนั้นที่ประจำอยู่ในประเทศไทย สำหรับชาวอังกฤษหรือบริติช เอกสารนี้เรียกว่า "Affirmation of Freedom To Marry" แปลได้ว่า "คำยืนยันการมีอิสรภาพในการสมรส" หรือที่เราเรียกกันสั้นๆว่าใบรับรองโสด ชาวบริติชขอทำได้ที่สถานทูตอังกฤษประจำประเทศไทยเท่านั้นค่ะ ส่วนบุคคลสัญชาติไทยไม่ต้องใช้หนังสือรับรองใดๆทั้งสิ้น

❤ ขั้นตอนการจดทะเบียนสมรส ❤

1. แบบฟอร์มใบรับรองโสด
ดาวน์โหลดแบบฟอร์มใบรับรองโสดที่ตรงกับสถานะสมรส คือ โสดและไม่เคยสมรสมาก่อน, เคยหย่าร้าง, เป็นม่าย

2. พิมพ์ใบรับรอง
พิมพ์ใบรับรองขึ้นมาใหม่ตามตัวอย่างบนหนึ่งหน้ากระดาษ ลงรายละเอียดส่วนตัวให้ถูกต้อง อย่าลืมเช็คตัวสะกดโดยเฉพาะชื่อต่างๆที่แปลจากไทยเป็นอังกฤษเพราะผิดพลาดได้ง่าย รวมทั้งตัวพิมพ์ใหญ่และพิมพ์เล็ก ปริ๊นท์ออกมาแต่ยังไม่ต้องเซ็นชื่อ เพราะต้องเซ็นต่อหน้าเจ้าพนักงานกงสุลค่ะ

3. นัดหมายสถานทูต
นัดหมายวันและเวลาทำใบรับรองที่สถานทูตอังกฤษบนเว็บไซต์นี้

4. ไปสถานทูต
สิ่งที่ต้องเตรียมไปที่สถานทูตอังกฤษถนนวิทยุ:
- ใบรับรองที่พิมพ์มาเรียบร้อย
- พาสปอร์ตยูเค
- ค่าธรรมเนียม 2,300 บาท จ่ายด้วยเงินสดหรือบัตร
- หลักฐานการเปลี่ยนชื่อสกุลถ้ามี
- ถ้าเคยสมรสมาก่อนต้องมีหลักฐานเพิ่มเติมดังต่อไปนี้
- - ใบรับรองการสิ้นสุดการหย่าที่ออกโดยศาลครอบครัวที่ยูเค - ในกรณีที่เคยหย่าร้าง
- - ใบรับรองการเพิกถอนทะเบียนสมรส - ในกรณีที่การสมรสกลายเป็นโมฆะ
- - ใบรับรองการเพิกถอนทะเบียนการครองชีวิตร่วมกัน (civil partnership) - ในกรณีที่ทะเบียนการครองชีวิตร่วมกันถูกเพิกถอน
- - ใบมรณะบัตรตัวจริงของอดีตคู่สมรส - ในกรณีที่เป็นม่าย
- - ถ้าเคยหย่า เพิกถอนการสมรส หรือเพิกถอนการครองชีวิตร่วมกัน เกิดขึ้นในต่างประเทศนอกยูเค จะต้องมีหลักฐานว่าอดีตคู่สมรสได้อาศัยอยู่ในประเทศนั้นในเวลานั้นด้วย
*เอกสารใดๆที่ออกให้ที่ประเทศอื่นนอกเหนือจากยูเคและไทย จะต้องได้รับการรับรองความถูกต้องโดยสถานทูตของประเทศนั้นที่ประจำประเทศไทยเสียก่อน หากเป็นภาษาอื่นต้องแนบฉบับแปลภาษาอังกฤษไปขอรับรองด้วย - ตัวอย่างเช่น ทะเบียนหย่าของประเทศโปแลนด์ ต้องนำไปแปลเป็นภาษาอังกฤษ จากนั้นนำไปขอรับรองคำแปลที่สถานทูตโปแลนด์ประจำประเทศไทย แล้วจึงจะนำไปใช้ยื่นทำใบรับรองโสดได้
*หลักฐานทุกชิ้นต้องเป็นต้นฉบับตัวจริงเท่านั้น

5. แปลใบรับรอง
ต้องจ้างแปลโดยศูนย์แปลที่มีใบอนุญาตหรือได้รับการรับรองโดยสถานทูตอังกฤษ ระมัดระวังเรื่องการแปลชื่อและนามสกุลเป็นภาษาไทยให้อ่านได้ถูกต้องและตรงกับหลักภาษา ดูรายชื่อบริษัทแปลได้บนเว็บนี้
ค่าบริการแปลประมาณ 200-400 บาทค่ะ

6. รับรองคำแปล
นำเอกสารที่แปลแล้วไปขอรับรองนิติกรณ์คำแปลเอกสาร ที่กองสัญชาติและนิติกรณ์ ชั้น 3 กรมการกงสุล กระทรวงการต่างประเทศ ถนนแจ้งวัฒนะ
ค่าธรรมเนียม 400 บาท
ยื่นคำร้องเวลา 8:00 - 15:00 น. จันทร์-ศุกร์
ใช้เวลาดำเนินการ 3 วันทำการ

7. จดทะเบียนสมรส
สิ่งที่ต้องเตรียมไปที่เขตหรืออำเภอ:
- ชาวไทย: บัตรประชาชนและทะเบียนบ้าน
- ชาวอังกฤษ: ใบรับรองโสดและพาสปอร์ต 
- พยานสองคนซึ่งจะเป็นใครก็ได้ที่อายุ 18 ขึ้นไป นำบัตรประชาชนมาด้วย
ไปจดทะเบียนสมรสที่สำนักทะเบียน ณ เขตหรืออำเภอในท้องที่ตามที่ได้ระบุไว้ในใบรับรองโสด ยื่นเอกสารที่ได้รับการประทับตราต่อนายทะเบียน ณ ที่ว่าการเขต/อำเภอในประเทศไทย เมื่อเรียบร้อยครบถ้วนกระบวนความ นายทะเบียนจะออกทะเบียนสมรสให้คู่สมรสทั้งสองฝ่ายคนละ 1 ชุด
*แนะนำให้จดทะเบียนที่เขตบางรัก เนื่องจากเจ้าหน้าที่รู้งาน บริการดี และไม่มีค่าใช้จ่ายแอบแฝงค่ะ
ค่าใช้จ่ายวันนี้ไม่เกิน 40 บาทค่ะ

การสมรสจะมีผลสมบูรณ์ตามกฎหมายยูเค
- เมื่อทำถูกต้องทุกขั้นตอนตามกระบวนการที่กล่าวมา หรือตามกฎหมายไทย
- ถ้าการสมรสครั้งนี้ไม่ขัดกับกฎหมายยูเค
ไม่ต้องจดทะเบียนสมรสซ้ำที่ยูเคอีกต่อไปค่ะ

8. การเปลี่ยนนามสกุลตามสามี
สาวไทย - สามารถเลือกได้ว่าจะใช้นางหรือเก็บนางสาวไว้ ส่วนนามสกุล จะใช้นามสกุลเดิม ใช้นามสกุลสามี หรือเก็บนามสกุลตัวเองเป็นชื่อกลางแล้วเปลี่ยนไปใช้นามสกุลสามีก็ได้เหมือนกันค่ะ รายละเอียดเหล่านี้นายทะเบียนจะถามระหว่างที่จดทะเบียนสมรส ถ้าเราตัดสินใจว่าใช้นามสกุลสามี นายทะเบียนจะให้สามีเซ็นยินยอมในหนังสือยินยอมให้ใช้นามสกุล เสร็จแล้วพาสามีไปยืนยันการเปลี่ยนนามสกุลกับเราที่อำเภอหรือเขตตามทะเบียนบ้าน แก้ทะเบียนบ้าน และทำบัตรประชาชนใหม่

9. ทะเบียนสมรส
ทะเบียนสมรสประกอบด้วย;
- ทะเบียนสมรส คร.2 : มีลายเซ็นของทุกฝ่ายและข้อตกลงต่างๆ
- ใบสำคัญการสมรส คร.3 : เป็นกระดาษแข็งลายดอกไม้
หากต้องการนำทะเบียนสมรสไปใช้ในการขอวีซ่าสำหรับสหราชอาณาจักร ต้องนำทะเบียนไปแปลเป็นภาษาอังกฤษ จะแปลเองแล้วเซ็นรับรองเองหรือจ้างร้านแปลก็ได้ ไม่จำเป็นต้องส่งให้หน่วยงานใดๆของรัฐเช่นกงสุลประทับตรารับรองค่ะ แต่ถ้าจะใช้ขอวีซ่าไปประเทศอื่นๆนอกเหนือจากสหราชอาณาจักร ควรจะนำไปประทับตรานิติกรณ์รับรองคำแปลด้วย

❤ Getting Married legally in Thailand ❤

1. Affirmation of marrital status form
Download the right affirmation form for you; single and never been married, divorced, or widowed.

2. Typing the form
Retype the affirmation on one page in the same format as the sample, adding your details where required. Check the names' spelling, upper case and lower case carefully. Print it out but don’t sign it - you’ll need to sign at the embassy before a consular officer.

3. Book appointment
Make an appointment at the embassy in Bangkok to swear your affirmation on this website.

4. At British Embassy
British Embassy, Wireless Rd, Bangkok
On the day of appointment, you’ll need to bring:
- The printed affirmation
- Your UK passport
- Fee 2,300 THB, cash or card
- evidence if you’ve changed your name by deed poll
- If you’ve been married or in a civil partnership before, you’ll also need the following evidence:
- - your original decree absolute or final order - if you’re divorced
- - your annulment certificate - if your marriage or civil partnership was annulled
- - your civil partnership dissolution - if your civil partnership was dissolved
- - your partner’s death certificate and marriage certificate - if you’ve been widowed
- - If your divorce, civil partnership dissolution or annulment took place outside the UK, you’ll need evidence that you or your ex partner lived in or were a national of that country at the time.
*Certificates issued in a third country outside UK and Thailand must be certified by its respective Embassy in Thailand. This certificate if not in English must be accompanied by an English translation.
*Only the original evidence or an official certified copy will be accepted.

5. Translate the affirmation
Have the affirmation translated into Thai by a licensed translator. You and your partner may need to recheck your names in Thai, both spelling and pronunciation need to be correct. Look for a translator on this list
This service normally costs 200-400 Thai baht

6. Legalise the translation
Obtain authentication of the British Consular Official’s signature on the affirmation and its translation. This must be obtained from the Legalisation Division, 3rd Level, Department of Consular Affairs, Ministry of Foreign Affairs, Chaeng Wattana Road, Bangkok
Fee: 400 Thai baht
Submission: 8:00 - 15:00 Monday - Friday
Collection: within 3 days

7. Register Marriage
You’ll need to bring:
- Thai: national ID card and House Registration
- British: affirmation and passport
- Two witnesses, can be anybody age 18 and over, bring their national ID cards
At the local district office where you've specified in your affirmation. The registrar will marry you and give you 2 identical marriage certificates in Thai.
*Bang Rak district office (Bangkok) is highly recommended. They are best known for making marriage registration easy-peasy, and with them there should be no 'hidden cost'.
This process will cost less than 40 Thai baht.

Your marriage will be recognised in the UK immediately if:
- you follow the correct process according to the law in Thailand
- it would be allowed under UK law
You don’t need to re-register your marriage in the UK.

8. Changing of surname
In case of marrying Thai woman, your spouse will have choices wether to keep her title - Miss or using Mrs. She can also choose to keep her family name, or use your family name, or keep both names, these are all legal in Thai law. If she decide to use your family name, your marriage registrar will ask you to sign the Agreement to use Surname. Then you and your spouse can go to the district office where her house is registered, to change her details on the documents.

9. Thai Marriage Certificates
Your registrar will give each of you a copy of two documents;
- Kor.Ror.2 Marriage Registration - has details of marriage agreements and signatures
- Kor.Ror.3 Marriage Certificate - is printed on a specially designed certificate
You can now translate them into English, by yourself or a translator, and they are ready to be used in the UK or applying for a UK visa. If you want to use these documents in other countries apart from UK and Thailand, or applying for their visas, you may also need to get the translations legalised.

*If your partner is a Thai citizen with only Thai passport, your partner can apply for a settlement visa to live in the UK with you. After five years of living in the UK with a settlement visa, they will be eligible for applying to be a permanent residence. They can also apply for British citizenship once they obtain the permanent resident permit.

*If your partner is a Thai citizen who has dual citizenship, or also hold a foreign passport of EU countries. They will be able to live in the UK without a visa. They can apply for British citizenship once they’ve lived in the UK for 3 years.
